Position Summary

The Associate Attorney provides direct legal representation in both family-based and employment-based immigration matters. The attorney manages an active caseload from consultation through resolution, develops legal strategies, prepares petitions and applications, conducts legal research, and represents clients before USCIS, EOIR, and other government agencies as appropriate. The Associate Attorney collaborates with attorneys, paralegals, administrative staff, interpreters, and interns to provide exceptional client service while maintaining the highest ethical and professional standards.

Primary Responsibilities

Conduct legal consultations and evaluate immigration options for individuals and employers. Develop case strategies and maintain regular communication with clients. Prepare clients for USCIS interviews, consular interviews, and immigration court hearings. Represent clients before USCIS, EOIR, and other administrative agencies as appropriate. Manage employment-based immigration matters, including H-1B, H-2A, H-2B, L-1, O-1, R-1, TN, PERM, I-140, Adjustment of Status, EB-1, and National Interest Waivers. Prepare and manage family-based immigration matters, including family petitions, adjustment of status, consular processing, naturalization, waivers, humanitarian applications, and removal of conditions. Advise employers regarding I-9 compliance, E-Verify, immigration compliance programs, and workforce planning. Draft petitions, applications, briefs, motions, affidavits, RFEs, and NOID responses. Conduct legal research and remain current on immigration law and policy developments. Manage deadlines and maintain accurate case records. Supervise and mentor paralegals, legal assistants, interns, and support staff. Collaborate with the legal team to develop effective case strategies and improve firm processes.

Qualifications

J.D. from an accredited law school.

Licensed in at least one U.S. jurisdiction with the ability to become licensed in South Dakota.

0–3 years of legal experience or a demonstrated commitment to practicing immigration law.

Excellent legal writing, research, analytical, organizational, and communication skills.

Ability to work independently and collaboratively.

Spanish language proficiency is preferred but not required.

Travel

Occasional travel for Immigration Court, USCIS interviews, South Dakota state courts, client meetings, and community events, including Fort Snelling Immigration Court and the Omaha USCIS Field Office.
